Sydney Whale Watching Adventure Cruise

Whales are sighted on approximately 95% of cruises, however they are wild animals and sightings cannot be guaranteed.

If whales are not sighted, passengers will receive a complimentary return cruise until they sight whales. This offer is non-refundable, non-transferable, and not redeemable for cash.

It is recommended that passengers take precautions for motion sickness where necessary.

Passengers are advised not to bring valuables. No responsibility is accepted for loss or damage to personal

property.

Whale Watching operates in all weather conditions, unless deemed unsafe. Services may be delayed, rescheduled, or cancelled due to weather or operational requirements. Where a service cannot proceed, passengers will be offered an alternative date or time.

Whale Watching Terms & Conditions: Please carefully read and understand the following terms and conditions before booking a whale watching tour with us. By booking a tour, you agree to adhere to these terms and conditions. We reserve the right to update or modify these terms and conditions at any time by posting updated terms on this website. Any changes will become effective upon publication. It is the passenger's responsibility to review these terms before booking.

Conditions of Entry: Passengers are expected to behave responsibly and respectfully during the whale watching tour. If you fail to comply, we may cancel or suspend your booking and/or remove you from the premises. We reserve the right to refuse service to those who are believed to be affected by alcohol or drugs and no refund will be provided.

Weather and Safety: The safety of passengers and crew is our top priority. Sydney Harbour Attractions reserves the right to substitute any vessel at any time. Trips may be rescheduled or cancelled due to adverse weather conditions or other safety concerns. We will operate if it is raining. We reserve the right to cancel services due to inclement weather (generally defined as precipitation greater than a drizzle, wind, and swell conditions). In such cases, we will attempt to reschedule the ride at no cost, or a compensatory voucher will be supplied. You may experience seasickness during this cruise. If you are prone to seasickness, you make take some of the following precautions: • Eat sensibly. Avoid big breakfasts/lunches as well as rich and fatty foods. Please ensure to still eat something, as being hungry can also lead to nausea. • Check the weather. Seasickness may depend on or be aggravated by the conditions of the sea. It is strongly recommended that you check the weather as calmer sea conditions make you less prone to seasickness and offer a more enjoyable cruise. • Focus on a fixed point. Focusing on a point on shore or the horizon helps your balance as your brain and inner ear resynchronise with one another. • Visit your doctor or local pharmacist. Ask them about travel sickness remedies and tablets you can take prior to your cruise.

Delays and Schedule Changes: We will make every effort to adhere to the agreed upon departure and arrival times. However, circumstances or unforeseen delays may impact the schedule. We are not responsible for any inconvenience or expenses incurred due to delays or schedule changes.

Whale Sighting Guarantee and Rebookings: We will make every effort to spot whales on every cruise. However, in the highly unlikely event that they are not spotted, we offer whale sighing guarantee. This allows you to rebook for a complimentary whale watching cruise during whale season that falls within 12 months of your original booking. Please note, these complimentary vouchers are non-transferable and cannot be used in exchange for a refund.

Liability: We carry appropriate insurance for passenger liability and conform to all applicable laws and regulations. We are not liable for personal injury, illness, or accidents that may occur during the whale watching tour. Passengers are responsible for their personal belongings. We are not liable for equipment loss or damage to personal property / valuables during the journey.

Privacy: We may collect and store passenger information for booking and communication purposes. We will not share this information with third parties without consent. By booking a tour with us, you acknowledge that you have read, understood, and agreed to these terms and conditions. After the product is successfully booked, we will send you a confirmation voucher. The main information about the reservation and the precautions for participation will be provided on the confirmation voucher. Please read it. If you do not have any feedback, we consider that you have read and know all the information on its confirmation.

As an intermediary agency, we are only responsible for making travel product reservations for tourists.

We recommend that tourists purchase travel insurance. Tourist product suppliers such as tourist attractions, hotels and transportation companies will be directly responsible for the quality, service and safety of travel products. We are not responsible for any safety issues with the products ordered.

In the event of an unexpected situation without insurance, we will only assist in handling it.

If the booking is forcibly cancelled due to the reasons of the travel product supplier, we will refund the full amount corresponding to the booking without additional compensation.

No show: Ticket holders who 'no show' without prior cancellation or notification are not eligible for a refund.

We will try our best to assist tourists to communicate and negotiate solutions with tourism product suppliers.

For some marine products (including but not limited to various cruises, whale watching cruise, etc.), the supplier reserve the right to arrange alternative vessels or make changes to itineraries, service timetables, routes and/or destinations. The supplier may cancel or abandon the cruise if they consider it necessary for weather or safety reasons and except as expressly stated in these Terms and Conditions, we will not be liable for any loss or expense incurred by the Passenger caused by such substitution or cancellation.

When visiting attractions or participating in activities, please strictly adhere to the instructions provided by the venue or staff. Ensure you fully understand the associated risks (refer to venue announcements or the safety waiver required for signature for specific details), cooperate as required to implement appropriate safety precautions, and strictly refrain from engaging in any dangerous behaviors during the activity.
